Open Records Request

All requests to Planning and Development Services of Kenton County (PDS) for records under the Kentucky Open Records Act [KRS 61.870 to 61.884] shall adhere to this policy and state law. 

Principal Office and Hours

PDS's principal office is 1840 Simon Kenton Way, Suite 3400, Covington, KY 41011. Its regular business hours are 8:00 a.m. to 5:00 p.m. EST, Monday through Friday, excluding holidays.

Procedure to Request Public Records

  • Kentucky​ residents wishing to inspect a nonexempt record for a noncommercial purpose may submit an open records request by completing the Open Records Request Form.
  • Any requester shall direct their request to inspect records to the official custodian. 
  • The request shall be hand-delivered, mailed, or emailed to the official custodian.
  • PDS shall determine whether to grant or deny the request within five (5) days (excluding weekends and holidays), and within said five (5) day period, the official custodian shall notify the requester in writing of the determination. 
  • Depending on the type of record and the nature of a request, records may be made available to a requester by either of the following methods: (1) a requester may inspect the records during regular business hours and at the principal office of PDS; or (2) by receiving copies of the records from PDS (whether through mail or email).

Fees

The following rates of reimbursement of expenses under the Open Records Act for noncommercial purposes apply. Total fees shall be payable in advance of the records being reproduced.

  • Printing costs: $0.10 per page
  • Copies of photographs, maps, and other such records: actual cost
  • Postage and shipping: actual cost

Commercial Purposes

It is illegal for a person to obtain a copy of any part of a public record for a commercial purpose without disclosing the intended commercial use. The public agency may ask for a certified statement from the requester stating the commercial purpose for which they will be used, and a contract may also be required. This contract will allow the use of the public records for the specified commercial purpose for a fee. The fee may be based on the costs incurred by the public agency for media, processing, staff, and the acquisition of the public records.
